Diese Nutzungsbedingungen regeln das Vertragsverhältnis zwischen dir („Nutzer“) und dem Betreiber der App ShareSyncGo („Anbieter“) über die Nutzung der iOS-App ShareSyncGo.
ShareSyncGo ist eine Companion-App für iOS, die Routen vom iPhone an eine kompatible Garmin-Uhr überträgt und dort Abbiegehinweise, Distanz und Ankunftszeit anzeigt. Die App nutzt Apple MapKit für die Routenberechnung und das Garmin Connect IQ Mobile SDK für die Übertragung an die Uhr.
Der Vertrag über die kostenfreie Nutzung der App kommt mit der Installation auf deinem Gerät zustande. Ergänzend gilt der Apple-Standard-Endbenutzer-Lizenzvertrag (Apple Standard EULA): apple.com/legal/internet-services/itunes/dev/stdeula.
Der Anbieter räumt dir ein einfaches, nicht ausschließliches, nicht übertragbares Recht ein, die App auf den von dir verwendeten iOS-Geräten gemäß den Apple-Nutzungsregeln für App-Store-Apps zu installieren und zu nutzen. Eine Bearbeitung, Dekompilierung oder Weiterverbreitung ist außerhalb der gesetzlich zwingenden Grenzen unzulässig.
Die App ist vollständig kostenlos. Es gibt keine In-App-Käufe und keine Abonnements.
Der Anbieter bemüht sich um eine zuverlässige Funktion der App, schuldet aber keine ununterbrochene Verfügbarkeit. Funktionen, die auf Drittsysteme angewiesen sind (Apple MapKit, Garmin Connect Mobile, Garmin BLE-Verbindung), können bei Störungen dieser Drittsysteme zeitweise nicht oder nur eingeschränkt funktionieren.
Der Anbieter haftet unbeschränkt für Vorsatz und grobe Fahrlässigkeit sowie nach dem Produkthaftungsgesetz. Bei einfacher Fahrlässigkeit haftet der Anbieter nur bei Verletzung wesentlicher Vertragspflichten (Kardinalpflichten); die Haftung ist in diesem Fall der Höhe nach auf den vertragstypisch vorhersehbaren Schaden begrenzt. Eine Haftung für entgangene Daten, mittelbare Schäden oder Folgeschäden ist im Rahmen der gesetzlichen Zulässigkeit ausgeschlossen.
Der Anbieter kann diese Bedingungen mit Wirkung für die Zukunft ändern, wenn dies aus rechtlichen oder funktionalen Gründen erforderlich ist. Wesentliche Änderungen werden über die App-Store-Update-Notes angekündigt; widersprichst du nicht innerhalb von 6 Wochen nach Bekanntgabe der Änderung, gelten die geänderten Bedingungen als angenommen.
Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts. Zwingende verbraucherschützende Vorschriften deines Wohnsitzstaates bleiben unberührt. Gerichtsstand für Streitigkeiten mit Vollkaufleuten ist der Sitz des Anbieters.

These terms govern the contractual relationship between you ("User") and the operator of the ShareSyncGo app ("Provider") regarding the use of the iOS app ShareSyncGo.
ShareSyncGo is a companion app for iOS that forwards routes from your iPhone to a compatible Garmin watch and displays turn-by-turn instructions, distance and ETA there. The app uses Apple MapKit for route calculation and the Garmin Connect IQ Mobile SDK for transmission to the watch.
The contract for the free use of the app is concluded with the installation of the app on your device. Apple’s standard end-user licence agreement applies in addition: apple.com/legal/internet-services/itunes/dev/stdeula.
The Provider grants you a non-exclusive, non-transferable right to install and use the app on iOS devices used by you in accordance with Apple's Usage Rules for App Store apps. Modification, decompilation or redistribution beyond the limits permitted by mandatory law is not allowed.
The app is fully free. There are no in-app purchases and no subscriptions.
The Provider strives for reliable operation but does not guarantee uninterrupted availability. Features that depend on third-party systems (Apple MapKit, Garmin Connect Mobile, Garmin BLE link) may temporarily be unavailable or limited if those third-party systems experience disruptions.
The Provider is liable without limitation for intent and gross negligence and pursuant to the German Product Liability Act. For simple negligence the Provider is only liable for breach of material contractual obligations ("cardinal obligations"); in such cases liability is limited to damages typically foreseeable for this type of contract. Liability for lost data, indirect damages or consequential damages is excluded to the extent permitted by law.
The Provider may change these terms with effect for the future where this is necessary for legal or functional reasons. Material changes will be announced in App Store update notes; if you do not object within 6 weeks of notification, the changed terms shall be deemed accepted.
The laws of the Federal Republic of Germany apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of your country of residence remain unaffected. Place of jurisdiction for disputes with merchants is the Provider's place of business.
